Employment and Labor Law

 

Our law firm represents clients in employment matters including but not limited to labor negotiations, personnel matters, litigation and other disputes involving employment and labor matters.  We provide these services for both private clients and public entities. We have extensive experience in handling claims based upon discrimination/harassment, hostile work environment, employment at will, employee benefits and labor relations before administrative agencies.

 

We provide training to supervisors and employees related to labor issues in the workplace and sexual harassment.  We  draft personnel manuals for our clients.

 

We represent clients in disciplinary hearings including civil service entities, labor and special litigation matters and clients in negotiations with bargaining units.

 

We have negotiated numerous labor contracts through the years for various public and private entity clients.  We have appeared in the Administrative Law Courts and the Public Employee Relations Commission (PERC) on many occasions on labor related issues. In addition, our daily legal activity involves giving labor advice to our private and municipal clients.  We have experience and knowledge in matters alleging violations of the New Jersey Law Against Discrimination (NJLAD), the New Jersey Conscientious Employee Protection Act (CEPA), Title VII of the Civil Rights of 1964, the Americans With Disabilities Act (ADA) and the Family Medical Leave Act (NJFMLA).

Dispute Resolution Services​

 

The firm through the Hon. E. David Millard (Retired) (Of Counsel) provides dispute resolution assistance. These dispute resolution services include mediation, arbitration and complex case management.

 

In the mediation process, parties will discuss the potention for settlement with their attorney.  The firm provides a retired judge (E. David Millard) who acts as a third party facilitator to assist with the settlement negotiations between the parties.  He does not represent any of the parties, instead he meets with the parties and their attorneys to discuss the issues and options for settlement.  He will then meet with the parties individually.  All discussions, by statute, are confidential.

 

In the arbitration process, the parties cannot settle their matter.  They  may have agreed to terms prior to a dispute and submit their disagreement to arbitration.  This occurs where the parties had previously entered into a contract which required that any disagreement relative to the contract would be settled by arbitration.  In the alternative, during a dispute the parties may agree that they do not wish to submit their disagreement to the courts.  When a matter is submitted to our firm for arbitration, Hon. E. David Millard (retired judge) acts as the final decision maker.  He reviews the documents, listens to testimony and renders a decision.

 

 

Public Entity Practice

 

 

Our firm has significant experience representing local government clients and in dealing with municipal, county and other governmental related issues.  We serve as labor counsel to government bodies, independent authorities, boards of education and/or select agencies and boards.  We are currently counsel to the Joint Insurance Fund located in Ocean County.  We have an extensive background in representing public entities in labor/employment issues as well as many other matters.  We offer an array of services including but not limited to preparation of ordinances and resolutions, municipal court, condemnation proceedings and preparation of contracts and agreements.
